“Decisions Taken by Parliament Cannot Be Reopened in UT Assembly”: Sunil Sethi

Srinagar, Feb 17: The Bharatiya Janata Party (BJP) on Monday termed the resolution brought by Peoples Conference president and MLA Handwara Sajad Gani Lone for the restoration of Article 370 and Article 35-A as “unconstitutional,” stating that decisions taken by the Parliament cannot be reopened in the Assembly of the Union Territory.

Talking to the news agency—Kashmir News Observer (KNO), BJP chief spokesman advocate Sunil Sethi said, “It is against the constitution as decisions taken by the Parliament cannot be reopened in the Assembly.”

While Kashmir-based opposition parties are likely to back the resolution, all eyes will be on the stance of the ruling party and the Speaker.

Lone had last week submitted a resolution in the Assembly secretariat seeking the restoration of the pre-August 5, 2019 constitutional position. The resolution also condemns the abrogation of Article 370, Article 35A, and the Jammu & Kashmir Reorganisation Act in the strongest terms.

Lone, the most vocal critic of the NC-led government, has maintained that the resolution brought by the National Conference-led government in the first session of the House was ambiguous and did not clearly reject the August 5, 2019 decisions
